Frequently Asked Questions (FAQs)

OTT Compliance FAQs
1. What are the age-based categories for content classification on OTT platforms?
The IT Act 2021 specifies five age-based categories for content classification on OTT platforms: U (Universal), which is suitable for all age groups; U/A 7+, for content that is suitable for children aged 7 years and above with parental guidance; U/A 13+, for content that is suitable for children aged 13 years and above with parental guidance; U/A 16+, for content that is suitable for persons aged 16 years and above with parental guidance; and A (Adult), for content that is restricted to adults (persons aged 18 years and above).
2. Is it mandatory for OTT platforms to implement parental controls?
Yes, it is mandatory for all OTT platforms to implement parental controls for content classified as U/A 7+ or higher. The parental controls must be easy to use and must allow parents to restrict access to age-inappropriate content for their children. The platform must also provide a mechanism for age verification to ensure that children do not access adult content.
3. What is the role of a Grievance Officer for an OTT platform?
A Grievance Officer is responsible for acknowledging and addressing user complaints regarding content, compliance, and other issues within a stipulated timeframe as per the IT Act 2021. The Grievance Officer must acknowledge the complaint within 24 hours and dispose of it within 15 days. The name and contact details of the Grievance Officer must be prominently displayed on the platform.
4. What is the three-tier grievance redressal mechanism for OTT platforms?
The three-tier grievance redressal mechanism consists of: (i) a Grievance Officer appointed by the OTT platform; (ii) a self-regulatory body of which the platform is a member; and (iii) an inter-departmental committee constituted by the Ministry of Information and Broadcasting. A user who is not satisfied with the decision of the Grievance Officer can appeal to the self-regulatory body, and a user who is not satisfied with the decision of the self-regulatory body can appeal to the inter-departmental committee.
5. What are the penalties for non-compliance with the IT Act 2021?
Non-compliance with the IT Act 2021 can result in severe penalties, including the blocking of the platform, the imposition of fines, and criminal prosecution of the platform's executives. It is therefore crucial for all OTT platforms to ensure that they are in full compliance with the law.
